For example, a human does commit a murder when it kills a human. Killing is just a way of life for humans, and they do not know what they are doing is "wrong" because it is not subjectively wrong for them. It is just the nature of most of them.

That is one of the places where "agency" enters the fray. There are several different sorts of homicide - the killing of one human by another human. The specific sort of homicide called "murder" is the UNJUSTIFIED killing of one human by another human. There are justified homicide, and accidental homicides along with murder.

That is why the commandment specifies that "thou shalt no do murder". There are occasions where homicide is justified. The prohibition is specifically against an unjustified killing. It takes agency to know the difference.
