The only people getting a "free pass" here were straight kids having vaginal intercourse and by "free pass", at a judge's discretion they weren't automatically put on the sex offender list. Gay kids having oral or anal sex were not subject to the same rules because oral and anal sex weren't covered under the existing law and they were automatically placed on the sex offender list.

The only thing I really question here is why do they allow an age gap of 10 years? It has been that way for a long long time.
Knowledge is knowing that a tomato is a fruit. Wisdom is not putting it in a fruit salad.
