Latest Report: bad people escape from camp. ALERT... ALERT!
You know, if one has to "escape" from a medical facility, and a manhunt ensues, then it's probably not really a "medical facility"... I forget just now what they DO call those sorts of places that one has to escape from though...
.
Leaving a medical facility AMA (Against Medical Advice) is actually a patient right.
It can get iffy if a person is carrying a communicable disease, but the law would be on their side, if the person is testing negative as these folk were.
Circumstances are different in the the US, but the possibility was addressed and it is really up in the air about the results of such an encounter.
I have had discharge decisions that created a liability for the hospital, go to a judge for the the ultimate call. Most of the time, the judge will side with the patient, unless he allows his emotions to get in the way. With the heat that surrounds COVID, I would believe he will lean toward holding the patient, but I don't know how that would look. It could get really messy and most definitely a law suit would ensue.
Here is what the National Institute of Health has to say about it.
Quote:Q: Is it ethically permissible to allow a patient who is Covid-19 positive to leave AMA and return to her family?
One of the core values in the United States medical system is the principle of autonomy, which provides for patient choice and control over their medical treatment. Included under the umbrella of autonomy is the option for patients to refuse any medical treatments and testing that are not consistent with their medical values and treatment preferences. This right can manifest in a patient choosing to leave the hospital and be discharged against medical advice (AMA).
