Top mayor sues over Trump’s sanctuary city order, calls it unconstitutional

The mayor of Seattle says that President Trump’s order against sanctuary cities is unconstitutional, and he’s suing over the city’s right to disobey federal immigration authorities.

Mayor Ed Murray announced the federal lawsuit Wednesday, saying that Trump’s executive order about defunding cities who maintain “sanctuary city” policies is unlawful.
Murray said that undoing the policies would put more people at risk since illegal aliens would stop calling the police to report crimes over fear they might be deported.
“The time to act is now,” Murray said. “Inconsistent and incorrect statements from the Trump Administration have created too much fear and uncertainty. Communities become less safe every day under Trump’s orders as residents become more afraid to report crimes.”

“Of course, we are concerned about people, who carry guns,” she said, “who are involved in drugs, who are involved in gangs, who are involved in trafficking, and if they’re undocumented we’re going to enforce the law against them as we would anybody else. Los Angeles is another “sanctuary city” that is pushing back hard against the Trump administration’s threats. L.A. Mayor Gil Garcetti recently signed his own executive order forbidding all city employees from cooperating with federal immigration authorities. Some faith leaders are organizing “underground railroad” safe houses for illegal aliens to escape deportation.

Berkeley Joins Other Bay Area Cities Calling For Trump’s Impeachment

BERKELEY (KPIX 5) – While the resistance to President Donald Trump has largely been private citizens across the Bay Area and country, municipalities are jumping into the fray.

On Tuesday night, the Berkeley City Council passed a five-page resolution calling for the president to be impeached.
“We were one of the first cities to standup against apartheid – that’s a movement that took off and spread and that’s very important,” Councilmember Sophie Hahn told KPIX 5.

Berkeley City Councilmember Kate Harrison co-sponsored the resolution.

“I think it’s going to send a powerful message. I think we have no choice but to do this,” Harrison said.

The home of the Free Speech Movement wasn’t the first city in the Bay Area to pass a resolution calling for the impeachment of Mr. Trump. The cities of Richmond and Alameda got there first.

“We want to make sure we are on the right side of history,” said Alameda Vice Mayor Malia Vella. “Everything we do should be concerned about upholding civil rights, we should be concerned about upholding the Constitution.”

All three cities are sending their resolutions calling for investigations and impeachment to Rep. Barbara Lee (D-Oakland).
Howard Epstein from the San Francisco Republican Party calls the resolutions crazy.

“Since the election of President Trump, they’ve been acting like three year olds throwing temper tantrums,” Epstein said.

Back in Berkeley, Harrison said the calls for impeachment over Russia, foreign money and attacks on the press, are American values.

“This is not a matter of policy disagreement with taxes, how we approach healthcare, etcetera. This is about the very essence of our constitution,” Harrison said.

My State and cities in surrounding States have sanctuary cities. Any of them who refuse to follow the law should get fired for not doing their jobs properly. For too many years, illegals were hired before a citizen. For too many years, illegals have scammed the system to receive food, cheap housing and medical with stolen ID's and fraudulent documents. I could go on and on. It's about time we have a President who is doing something about illegal immigration. Too many lives have been lost at the hands of illegals who have been deported only to come back again. Many were deported numerous times only to commit more crimes. We have a proper way of coming here and it isn't fair to those who are coming here through the proper channels to have others just waltz across the boarder or over stay a visa.

California's Supreme Court Chief Justice Tani Cantil-Sakauye, was having a problem understanding that Federal Law Over-Rides State Law and arrest can be made in a California Court House by Federal Agents.

SACRAMENTO, Calif. (AP) -- Attorney General Jeff Sessions and Homeland Security Secretary John Kelly have defended federal agents who make immigration arrests at courthouses after California's top judge asked them to stop, according to a letter released Friday.


Sessions and Kelly sent the letter Wednesday to California Supreme Court Chief Justice Tani Cantil-Sakauye, saying state and city policies barring local law enforcement from turning over suspects for deportation have compelled federal agents to arrest immigrants at courthouses and other public places.

Courthouses are a safe place for federal agents to make the arrests because visitors are typically screened for weapons, the letter says.
"While these law enforcement personnel will remain mindful of concerns by the public and governmental stakeholders regarding enforcement activities, they will continue to take prudent and reasonable actions within their lawful authority to achieve that mission," it says.

The response comes amid a feverish debate nationwide over the relationship between local law enforcement and immigration officials. Many counties and cities have refused to collaborate with immigration authorities after President Donald Trump signed executive orders to step up deportations.

In response, the administration has warned that those jurisdictions run the risk of losing federal funding.
Cantil-Sakauye, who was appointed by former Republican Gov. Arnold Schwarzenegger, asked federal officials to stop making immigration arrests at California courthouses, saying officers' practice of "stalking" immigrants was thwarting justice.

In their reply, Sessions and Kelly took issue with Cantil-Sakauye's accusation, writing that "stalking" is a crime where a victim is being followed or harassed.

"The arrest of persons in a public place based upon probable cause has long been held by the United States Supreme Court as constitutionally permissible," they wrote.

Cantil-Sakauye said Friday she was disappointed that courthouses would not be added to the list of "sensitive areas" where immigration officials don't make deportation arrests. They include schools, churches and hospitals.

"I appreciate the prompt letter and their admission that they are in state courthouses making federal arrests," Cantil-Sakauye said in a statement.
"However, making arrests at courthouses, in my view, undermines public safety because victims and witnesses will fear coming to courthouses to help enforce the law."

Without witness and victim testimony as evidence, dangerous suspects could go free, San Francisco District Attorney George Gascon said. He said local policies protecting immigrants aren't to blame and urged federal officials to get a warrant to make immigration arrests.

"The idea that entering courthouses to make immigration related arrests somehow enhances public safety is disturbingly backwards," Gascon said in a statement.
